01 Who we are
Avora Poultry Systems, Inc. is a Massachusetts corporation operating an NPIP-certified hatchery (cert. #54-072) at 142 Mill Brook Rd., Worcester, MA 01609. References to "Avora," "we," "our," or "us" mean the company. References to "you" or "your" mean the customer placing an order or using this site.
02 Placing an order
Submitting an order is an offer to buy. We accept your offer only when we send a confirmation email and charge your payment method. We reserve the right to refuse or cancel any order before that point at our sole discretion, including when stock is exhausted, weather creates a transit risk, or the shipping address falls outside our service area.
03 Pricing and payment
Prices are quoted in U.S. dollars and exclude shipping unless stated otherwise. We charge your method on order confirmation. We may change prices at any time but never on an order already confirmed. Sales tax is collected where required by law.
04 Live arrival guarantee
We guarantee live arrival of every chick. If a chick is dead on arrival, photograph it inside the unopened or just-opened transit box, email flock@avorahatch.com within forty-eight hours of delivery, and we will refund the affected chick or ship a replacement on the next available hatch day. 05 Returns
Live animals are not returnable for welfare reasons. Defects, mis-shipments, and DOA cases are handled under the live-arrival guarantee above. Brooder accessories are returnable in unused condition within thirty days; details at avorahatch.com/returns.
06 Shipping risk
Title and risk pass to you when USPS scans the parcel as delivered. We are not responsible for chicks left unattended at a porch or post office for more than four hours after the first delivery scan. The live-arrival guarantee assumes you collect the parcel promptly per the tracking notification.
07 Acceptable use of the site
Don't scrape, mirror, fuzz, brute-force, or attempt to disrupt the site. Don't resell our content without permission. Don't submit fraudulent orders. We log requests and will pursue abuse civilly and criminally where appropriate.
08 Disclaimers
Chicks are living animals. Survival past the first weeks depends on your brooder setup, feed, biosecurity, and care. Our guarantee covers transit only; it cannot cover keeper error after delivery. Information on this site is provided for general guidance and is not a substitute for veterinary advice.
09 Limitation of liability
To the fullest extent permitted by law, Avora's aggregate liability for any claim arising out of an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost income from a flock that fails to lay.
10 Disputes
These terms are governed by Massachusetts law. Any dispute will be resolved in the state or federal courts located in Worcester County, Massachusetts. You and Avora each waive trial by jury where permitted by law.
11 Changes
We may update these terms; changes apply to orders placed after the new effective date. Continued use of the site after changes are posted constitutes acceptance.
